Scope

These terms govern the distance sale of our products to consumers through this website, under the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005). By placing an order you confirm that you have read and accepted them. The terms that apply are those in force when the order is placed.

Products and prices

We sell extra virgin olive oil that we produce ourselves. The main characteristics of each product (size, variety, description) are shown on its page. Pictures are for illustration only.

All prices are in euros and are final prices. VAT not charged: agricultural producer under the exemption scheme (art. 34, paragraph 6, Italian Presidential Decree 633/1972). Shipping costs are shown on the Shipping and returns page and in the order summary before payment.

Ordering and conclusion of the contract

To order, add the products to your cart, enter the delivery address, choose the shipping and payment method and accept these terms. Before paying you can check and correct all your details in the order summary.

The contract is concluded when the payment is authorised: at that moment you see the order confirmation page with a summary of your purchase. If a product turns out to be unavailable after the order, we will contact you and refund the corresponding amount.

If you choose bank transfer, the contract is concluded when the order is confirmed and the order is on hold until the payment is credited.

Payment

You can pay by:

  • credit or debit card, Apple Pay, Google Pay, through Stripe;
  • bank transfer: you will receive the payment details in the order confirmation; the transfer must be made within 5 days, otherwise the order is cancelled. We ship once the payment has been credited.

Payment details are entered directly on the secure systems of the payment service providers: we never receive or store your card details.

Delivery

Delivery areas, costs and times are described on the Shipping and returns page. The risk of loss of or damage to the products passes to you upon delivery.

Right of withdrawal

You have the right to withdraw from the contract, without giving any reason, within 14 days of delivery. The right does not apply to packages (bottles and tins) whose seal has been opened after delivery. All the details and the model withdrawal form are on the Right of withdrawal page.

Legal guarantee of conformity

All products are covered by the legal guarantee of conformity provided for by articles 128 and following of the Italian Consumer Code, for defects that appear within 24 months of delivery. Please report the defect to us within two months of discovering it, writing to the contact details above.

In the event of a defect you are entitled, at your choice, to a replacement of the product free of charge (repair is not possible for a food product) or, in the cases provided for by article 135-bis of the Italian Consumer Code, to a proportionate price reduction or to the termination of the contract with a refund of the amount paid.

Customer service and complaints

For any question or complaint you can write to us from the Contact page or at info@aziendalaserra.com. We usually reply within two working days.

Language and storage of the contract

The contract may be concluded in Italian or in English: it is concluded in the language of the website you use to order. After the order you receive the order confirmation by email, with a summary of the products, prices and charges and a copy of these terms: we recommend that you keep it. The contract is stored in our systems and, if you have an account, you can review your orders in your customer area; you can ask us for a copy at any time by writing to the contact details above. Each order records the version of the terms you accepted.

Alternative dispute resolution

If we cannot settle a complaint together, you can use an alternative dispute resolution (ADR) procedure provided for by articles 141 and following of the Italian Consumer Code, for example mediation before a body entered in the registers of the Italian Ministry of Justice. If you live in another EU country, the European Consumer Centre of your country can also help you. You can always go to court.

Applicable law and jurisdiction

The contract is governed by Italian law. If you habitually reside in another Member State of the European Union, this choice does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country. Disputes with consumers fall under the jurisdiction of the courts of the place where the consumer resides or is domiciled.
